SIEGEL REWARDS 

TERMS & CONDITIONS

YOUR USE OF THE PROGRAM WEBSITE OR PARTICIPATION IN THE REWARDS PROGRAM SIGNIFIES YOUR AGREEMENT TO THESE TERMS AND CONDITIONS.  IF YOU DO NOT AGREE, DO NOT USE THE PROGRAM WEBSITE OR ENROLL IN THE REWARDS PROGRAM.

 

I. Program Overview.

 

The Siegel Rewards Program (the “Program”) is a free program designed specifically for customers of Siegel Suites, Siegel Select, and Siegel Slots & Suites (collectively, the “Siegel Brand Properties”), which are managed by The Siegel Group Nevada, Inc. (“The Siegel Group”). The Siegel Rewards Program is available to all eligible guests (each a “Participant” or “you”) of the Siegel Properties. All Program Participants agree that access and use of the Program are subject to the terms and conditions set forth herein and all applicable laws. Any access is undertaken at the user’s own risk. These terms and conditions may change without prior notice.

 

II. Program Eligibility. 

 

To be eligible for the Program, Participants must be 18 years or older and a current paying customer of participating Siegel Brand Properties, must be on the registration card for the room, and must pay directly to the Siegel Brand Properties 100% of the then-applicable market rate in advance of the stay at the property. Customers paying by direct bill or later-received subsidies are not eligible to participate in the Program. The Siegel Group employees are not eligible and anyone who lives with them to participate in the Program.

 

III. Program Enrollment.

 

To enroll in the Program, a Participant must request enrollment when they become eligible to join. Upon enrollment in the Program, Participants will be assigned a user login in order to gain access to their account through the Program website.  Participants are required to create their password when they first login to their account. Participants are encouraged to keep login information in a secure location.  The security of and any unauthorized access to the Participant’s login information is the sole responsibility of the Participant. 

 

IV. Program Points.

 

a. Earning Points.  Participants who are registered with the Program will receive points for every dollar spent on rent, pet fees, pet rent, key fees, cleaning fees, surcharges, and late fees. Eligible dollar amounts will be rounded down to the nearest point. No points will be awarded for taxes or deposit paid. Participants will be required to present their Siegel Rewards Card at the time a payment is made. Failure to provide the Siegel Rewards Card at the time of payment may result in forfeiture of any and all points that would have been earned for that payment. Participants will receive points beginning from the date of their enrollment in the Program. No points will be awarded for eligible activity prior to enrollment.

 

i. Bonus Points. Bonus points will be automatically awarded to all active Participants after every 90 days of continuous stay payments at a single location beginning with the date that the Participant enrolls in the Program. Should there be a break in continuous payments at a single location, Participants will then be eligible to again begin the process of earning bonus points under this section once they again begin making continuous payments.

 

ii. Promotional Events. From time to time, Siegel Brand Properties, at its sole discretion, may sponsor events intended to promote participation in the Program. Additional points may be earned through these various promotions and offers. These promotions and offers may be terminated at any time, for any reason, without cause or warning. Rules and regulations for these promotions will be posted in the front office of each participating Siegel Brand Properties location.

 

iii. Referral Points. Participants may also earn points through the Siegel Brand Referral Program. Upon the move-in of a newly referred guest, the newly referred guest will be required to provide the first and last name of the person who referred them to the participating Siegel Brand Properties location including their telephone number and the current participating Siegel Brand Properties location of the referring guest. This information must be provided when prompted upon enrollment into the Program. In addition, the newly referred guest must become a Participant of the Program. The newly referred guest is solely responsible for providing this information at the time of move-in and their failure to provide this information upon move-in may result in forfeiture of any and all newly referred guest bonus points for the referring tenant. Existing Participants of the Program or Participants currently staying at a Siegel Brand Properties location are not considered “newly referred guest.”

 

b. Program Account.  Participants can view their total points earned at any time by accessing the Program website and selecting “Point Account.” The Program website provides Participant transaction details and point balance.  It may take up to ten (10) business days for points to be posted to the Participant’s account.  It is the Participant’s responsibility to inform their Siegel Property Manager of any discrepancies that they find in their account. Discrepancies will be investigated, and the Participant will be notified of the resolution. All investigations and resolutions are at the sole and absolute discretion of The Siegel Group. Participants will not lose any accumulated points when they move to another participating Siegel Brand Properties location.  Participants are responsible for keeping their contact information up to date.  Participants are responsible for maintaining the confidentiality of their account usernames and password and for restricting access to their computer. Participants agree to accept responsibility for all activities that occur under their account or password. Participants agree to immediately notify The Siegel Group of suspicion or knowledge of any unauthorized use of the Participant’s username and password. Participant agrees to hold harmless The Siegel Group, the Siegel Brand Properties, their affiliates, and Online Rewards.

 

b. Redeeming Points.  When a Participant has obtained sufficient points, Participant may redeem them for an item or item(s) from those described in the Siegel Online Catalog. The fulfillment of the merchandise and any issue regarding the redemption should contact Online Rewards of Dallas, TX. The Siegel Group is not responsible for reward redemption in any manner. All reward redemption inquires must be made to Online Rewards. Online rewards will provide email and toll-free telephone support for the Program Participants for issues with placed orders. Customer service and support is available from 8:30 AM until 5:30 PM EST. In most instances, Online Rewards will respond to issues the same day if received before 3:00 PM EST, otherwise within one (1) business day. Rewards items will be received within 7 to 14 business days following receipt of each order. Online Rewards will notify the recipient of any delays and will provide the recipient an opportunity to select an alternate item. Online Rewards reserves the right to make modifications to the Catalog in accordance with product availability. The Siegel Group and Siegel Brand Properties reserve the right to modify the merchandise available in the Siegel Rewards On-line Catalog at any time without notice. Specific merchandise is subject to availability and substitutions may be made based on availability or marketing conditions. Online Rewards shall use reasonable efforts to ensure that any replacement items are of a similar style and price-point. Claims for damage to or loss of a redeemed item must be filed with Online Rewards within 30 business days of receipt by a recipient of the ordered merchandise. Orders canceled after an item has been shipped, where the item is not damaged, may be subject to a 25% restocking fee, subject to the policies of each specific supplier and the condition of the item returned, including whether the item is returned in original packaging. Recipients are responsible for the cost of returning the items to the supplier as specified by Online Rewards customer service department. Defective merchandise must be returned for warranty replacement within 30 days, merchandise must be returned to the manufacturer for warranty service. The Siegel Group is not responsible for any redemption issues caused by Participant’s failure to maintain current contact information.

 

i. Taxes. Merchandise redeemed under the Program is subject to applicable federal, state and/or local taxes. Payment of taxes resulting from these awards is the sole responsibility of the Participant and not The Siegel Group, Siegel Brand Properties, or any of their affiliates or agents. The Siegel Group and/or Siegel Brand Properties will report earnings under this program in accordance with federal, state and local regulations.

 

ii. Shipping and Handling. Merchandise redeemed under the Program is subject to shipping and handling charges. The shipping and handling charges are included in the point value associated with each item in the Siegel Rewards Online Catalog and are represented in the overall value of the item.

 

c. Forfeiture of Points.  Participants who leave Siegel Brand Properties, or who are no longer a guest as the result of a sale, transfer, or de-branding of a Siegel Brand Property, will have no more than 30 days in which to redeem their points or to again become an eligible Participant. After the expiration of the 30 days, any and all remaining points will be forfeited. No credit, carryover, or redemption of points is available after eligibility is severed. Accounts that are inactive will be automatically locked. An inactive account is one which does not have any point earning activity for a period of 30 days. However, the program administrator shall have the authority, in its sole and absolute discretion, to lock Participant accounts for any reason. If Participant wishes to continue using the Program, they must re-apply for a new account. Once an account has been locked, all points associated with that account will be forfeited. Points not redeemed within 30 days from the Participant account’s last point earning activity will be forfeited.

 

d. Point Value.  Program points in a Participant’s account do not constitute property of the Participant. Points have no fixed value, are non-transferrable and are not redeemable for cash or any other form of credit. Points have no value until presented by the Participant for redemption in accordance with these terms. Program points may only be used to redeem merchandise from the Siegel Online Catalog.

 

V. Termination.

 

a. Termination of Participant Account. The Siegel Group, Siegel Brand Properties, and their affiliated companies at their discretion may terminate Participant’s account and/or cancel some or all of Participant’s points or other rewards accrued at any time for issues including but not limited to abusing, violating or defrauding the Program, points or reward redemption, or any federal, state or local law; delinquency or non-payment; involvement in legal proceedings against The Siegel Group or its affiliated companies; or destruction of property. No provision herein shall limit any of the available remedies The Siegel Group or its affiliated companies may have against Participant. Participant agrees that The Siegel Group and Siegel Brand Properties have the sole discretion to interpret all Program rules and regulations and Participant hereby agrees by participating in the Program to abide by their interpretation of these rules.

 

b. Termination of Program. The Siegel Group and Siegel Brand Properties reserve the right to terminate or otherwise modify the Program at any time for any reason without notice. If the program is suspended or terminated, any points must be redeemed within 30 days from the date of suspension or termination.

 

VI. General Terms.

 

a. Wavier and Limitation of Liability. THE SIEGEL GROUP AND THE SIEGEL BRAND PROPERTIES PROVIDES THE PROGRAM, AND TO THE FULLEST EXTENT PERMITTED BY LAW, EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DESIGN, ACCURACY, CAPABILITY, SUFFICIENCY, SUITABILITY, CAPACITY, COMPLETENESS, OR AVAILABILITY. Participant agrees that The Siegel Group and the Siegel Brand Properties do not represent, warrant, or guaranty that the Program or any such other products or services will be uninterrupted or without omission or error free. This program is not endorsed by or affiliated with the prize companies. By joining the Program, Participant hereby releases and discharges The Siegel Group, the Siegel Brand Properties, and any other party associated with the development or administration of this Program, their parents, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Siegel Entities”), from any and all liability whatsoever in connection with the Program, including without limitation legal claims, costs, injuries, losses, or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation or portrayal in a false light) (collectively, “Claims”).  THE SIEGEL ENTITIES WILL NOT BE LIABLE TO PARTICIPANT FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, EVEN IF AN AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF THE PROGRAM OR ANY SUCH OTHER PRODUCTS OR SERVICES. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore such exclusions may not apply to Participant. 

 

b. Modification and Severability. The Siegel Group reserves the right to make changes to the Program website, policies, and these Terms and Conditions of use at any time and without notice. If any of these Terms and Conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

 

c. Governing Law.  The Program shall be governed by the laws of the State of Nevada, without regard to conflicts of law principles. By joining the Program, Participant consents to jurisdiction by the state and federal courts sitting in Las Vegas, Nevada.

 

d. Privacy. The Program website is housed and operated by Online Rewards on behalf of The Siegel Group and Siegel Brand Properties. The Siegel Group and Siegel Brand Properties respect your privacy. Participant authorizes and acknowledges that choosing to participate in the Program and use of this website grants The Siegel Group and Siegel Brand Properties the non-exclusive, royalty-free right to use the information collected in conjunction with the Program. Online Rewards will not provide Participant information to third-party business partners without first obtaining Participant’s approval. By becoming a Participant, Participant authorizes The Siegel Group, the Siegel Brand Properties, and Online Rewards and their affiliates to contact Participant via e-mail and postal mail with Program administrative and transactional information. 

 

e. Third Party Websites. The Siegel Group, Siegel Brand Properties, and their affiliated companies do not control and are therefore not responsible for the content of any non-Siegel Group website which Participant may gain access to through the Program website. Links through non-Siegel Group websites are provided only as convenience and do not imply that The Siegel Group, Siegel Brand Properties, or their affiliated companies endorses, verifies, monitors, or accepts any responsibility for the content of any such website. In particular, The Siegel Group, Siegel Brand Properties, and their affiliated companies do not accept any liability for any infringement of any person's intellectual-property rights by, or liability arising out of any information or opinion contained on, any such third-party website.

 

f. Cookies. The Program website may use cookies to store both Participant’s personal and non-personal information. “Cookies” are small text files a website may use to recognize repeat visitors, facilitate the visitor’s ongoing access to and use of the website, and allow the website to track the visitor’s behavior and compile aggregate data for content improvements. By using the Program website, Participant agrees to the use of cookies.

 

g. Intellectual Property.  Unless otherwise noted, all materials, including without limitation, logos, graphics, designs, rich and moving media, other images, photos, content, creative, business and marketing plans, strategies, information about accommodations and amenities and similar information are copyrights, patents, trade secrets, trade dress, trademarks, service marks and/or other intellectual properties (“Intellectual Property”) owned and controlled by The Siegel Group, the Siegel Brand Properties or their affiliated companies and are protected by United States and international copyright laws irrespective of any designation (e.g. ©, ®, or ™ signs). The Program website or any portion thereof may not be used, reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose without the express written consent of the appropriate owning entity. Neither the Program website nor any of its contents or Intellectual Property may be modified or copied in whole or part in any form, including by framing, incorporation into other websites or other publication, or be used to create any derivative work. No links to the Program website may be included in any other website without the express written permission of The Siegel Group.
